1. Object and scope

These General Conditions of Contract and Use apply to visitors to the site www.hypedfam.com (hereinafter user) and to any transactions of a commercial nature carried out by the Customer through the virtual store at www.hypedfam.com.

Browsing the site, as well as purchasing any product in the virtual store at www.hypedfam.com, implies the acceptance of these General Conditions of Contract and Use by the User and the Client.

Hypedfam reserves the right to change these General Conditions of Contract and Use without prior notice, any changes being published on www.hypedfam.com. Changes to these General Conditions of Contract and Use shall only apply to orders placed after their publication date on www.hypedfam.com.

2. Information on content
The reproduction, transfer, distribution or storage of the contents of the www.hypedfam.com website without prior written permission granted by Hypedfam is prohibited for purposes other than strictly personal use.

Hypedfam reserves the right to modify at any time the information and commercial offer presented on: Products, prices, promotions, commercial conditions and services, such changes being applicable only for future orders and not applicable to current orders.

The introduction of links from the present website, regardless of the intended purpose, without prior authorization from Hypedfam is expressly prohibited. Use of the hypedfam.com domain for abusive purposes without prior authorization shall be subject to legal action by Hypedfam. In the event that you find links to www.hypedfam.com on other websites, we hereby inform you that Hypedfam shall not be held liable either for the origin of the page or for the content contained therein.

3. Liabilities and cases of force majeure

All products sold on the site www.hypedfam.com are in accordance with Portuguese law.

Hypedfam shall not be liable for delays and/or defaults due to force majeure, including public order disturbances, total or partial strikes, events involving the absence or malfunction (including delays) of postal services and means of transport or communication, flood, fire, tornado, hurricane, volcanic eruption, war, pandemic.

Hypedfam is not liable for any indirect damages, including loss of profit, loss of benefit, loss of opportunity, damage or fees which may arise in connection with the purchase of any product featured on the Website, nor is Hypedfam liable for any loss of profit or consequential damages in respect of any purchase made on the Website which for any reason whatsoever cannot be delivered in conformity with and in accordance with what was ordered.

The website is exclusively directed to the final consumer and not to professionals.

4. Clients' and Users' Obligations

The Client and the User undertake to comply with and respect these General Conditions of Contract and Use, namely:

Refrain from introducing, storing or disseminating through the site defamatory, obscene, offensive, xenophobic and/or any other content that violates the general principles of law and order;

To keep, and not disclose, your site password in order to prevent others from accessing your account at Hypedfam.com

Not to use false identities;

To provide the correct personal data and addresses so that Hypedfam can properly process orders.

It is therefore expressly forbidden to its users to transmit messages or information that are injurious, misleading, defamatory, obscene or that violate, in any way, the right to privacy or the intellectual or industrial property of others, as well as the provision of any information that may be harmful to third parties or to the owner of the site.

Hypedfam reserves the right to delete the account of any user who fails to comply with any of these Obligations.

The Customer is responsible for the accuracy of the data communicated to Hypedfam and undertakes to immediately enter any changes thereto into his Hypedfam Registration Account at www.hypedfam.com.

Hypedfam disclaims any liability for any delay or impossibility in processing the order, in particular upon delivery, resulting from error or insufficiency of the data communicated by the Customer.

5. Placing orders online

The sale prices indicated on the website are exclusive and in Euros, with taxes and fees included. Delivery charges are borne by the customer and are charged at the end of the order, depending on the products selected and the final value. Additional transport, delivery, postal and/or other charges may apply.

Hypedfam reserves the right to change prices at any time, but will always apply the price indicated on the Website at the time the Customer places the order (except in the event that an error/lapse is identified on the Website, in which case Hypedfam may cancel the order/purchase made by the Customer, returning the amount paid, without any additional charge/cost to hypedfam).

Hypedfam reserves the right to modify at any time the information and commercial offers presented on the website regarding products, promotions, commercial conditions and services.

6. Product characteristics

The photographs of the products shown on the website are merely illustrative, do not enter into the contractual field, and do not replace any commitment on the part of the company.

With regard to descriptions, specifications and other details about products from our partners and/or suppliers, Hypedfam disclaims any and all liability as to the validity and completeness of their content.

Since the data inserted in the website is based on information provided to the company by its suppliers, we make every effort to ensure that there are no clerical and/or calculation lapses.

Whenever errors/lapses occur and are identified, we will endeavor, as soon as possible, to correct them, and the company reserves the right to cancel the order/purchase made by the customer and refund the amount paid by the customer.

If information presented on the website is identified that does not correspond to the characteristics of the product(s) and an order is placed for that product(s), the customer will be informed and will have the right to cancel his or her purchase.

7. Availability of articles

Hypedfam undertakes to respect the deadlines for an order as long as and when stock is available. If any ordered product is not available from stock, Hypedfam will contact the Customer by e-mail or by phone within an estimated period of 48 (forty-eight) hours from the date of the order in order to inform of the new delivery time for the product or request to change it to a similar one.

Except in the case of force majeure, Hypedfam undertakes to ship your order within thirty (30) days from the day after you place your order.

Due to technical and/or circumstantial issues, there may be a discrepancy between the quantities shown on the website for sale and the quantities in stock.

All promotional campaigns have limited stock and are exclusive to online marketing.

Currently, the website only accepts orders for delivery within the European Economic Area.

8. Exchanges and Returns

The following terms and conditions apply only to purchases made at www.hypedfam.com

Right of Free Resolution

Having purchased an item on hypedfam.com, you have a period of 14 days to return it, as of the receipt of the order, under the terms of the right of free resolution, provided for in Decree-Law no. 24/2014, of February 14. You may do so, provided that the following conditions are met:

  • Presentation of the product purchase invoice.
  • The product must be delivered in the same condition in which it was sold - no scratches, no external damage or signs of use, and in perfect condition, packed in its original packaging.

To do so, the Customer must contact Hypedfam.com Customer Support, who will provide him with all information regarding the exchange or return process. Under no circumstances shall the Customer send the goods to Hypedfam without prior contact as they will not be received.

Excluded from the Right of Free Resolution, within the period of 14 days indicated, are the contracts of:

  • goods made to your specifications or customized or which, by their nature, cannot be returned or are likely to deteriorate or perish rapidly;
  • sealed goods not returnable for reasons of health protection or hygiene, when opened after delivery;
  • goods which, after delivery and by nature, are inseparably mixed with other articles.

The money will be refunded in the same way as the payment was made within 14 days.
